High-Asset Divorce
A great deal of the time and work in a typical divorce is spent on asset division. It is no surprise, then, that a divorce involving significant assets or high net worth will be more complex and require greater attention to detail.
At Gauthier Family Law, we are prepared for the complexities associated with high-asset divorce. We have the skills and experience to discover hidden assets, value property and assets and apply the Illinois Marriage and Dissolution of Marriage Act to obtain a successful resolution of your divorce case.
Taking Inventory And Valuating Assets
One of the potential pitfalls in high net worth divorce is the risk that one spouse will try to hide assets from the other. Attorney Michael Gauthier begins by conducting his own thorough inventory of known assets, and works with you to determine the best strategy to discover possible hidden assets. He may also work with other finance professionals as necessary, including CPAs, actuaries, real estate appraisers and business valuators. If your spouse attempts to conceal assets, we work to uncover them and bring the attempted concealment to the court’s attention.
We will also carefully and accurately assign value to all assets, including non-liquid assets that are not easily divided.
Reaching A Fair And Equitable Settlement
Illinois uses the equitable distribution model for asset division. This means that all marital assets must be divided equitably between both spouses, but not necessarily equally.
For assets which are not easily divided, such as one spouse’s business, we work to ensure that the other spouse’s share of those assets is properly calculated and balanced with other available assets.
We will also take the time to discuss your specific goals for the settlement — whether that means keeping the marital residence or protecting your retirement accounts, for instance. As we go through the process, we will negotiate or litigate with those goals firmly in mind.
